He flourished at Ramerupt and Dampierre, France in the twelfth century.</p> <p>Biography</p> <p>On his father's side Isaac was a grandson of R. Simhah ben Samuel of Vitry, author of the Maḥzor Vitry; on his mother's side he was a nephew of Rabbeinu Tam, of Rashbam, and of Isaac ben Meir (RiBaM), a great-grandson of Rashi, and a relative of R. Eleazar of Worms. He was surnamed "ha-Zaḳen" (the elder) to distinguish him from another tosafist of the same name, Isaac ben Abraham surnamed "ha-Baḥur" (the younger). He is often quoted as R. Isaac of Dampierre. but it seems that he lived first at Ramerupt, where his maternal grandfather resided. It was also at Ramerupt that he studied under his uncle Rabbeinu Tam after the latter had gone to Troyes, Isaac b. Samuel directed his school.</p> <p>Isaac settled at Dampierre later, and founded there a flourishing and well-attended school. It is said that he had sixty pupils, each of whom, besides being generally well grounded in Talmud, knew an entire treatise by heart, so that the whole Talmud was stored in the memories of his pupils. As he lived under Philip Augustus, at whose hands the Jews suffered much, Isaac prohibited the buying of confiscated Jewish property, and ordered that any so bought be restored to its original owner. A particular interest attaches to one of his responsa, in which he relies on the oral testimony of his aunt, the wife of R. Isaac b. Meïr, and on that of the wife of R. Eleazar of Worms, a great-granddaughter of Rashi.</p> <p>He died, according to Heinrich Graetz about 1200; according to Henri Gross between 1185 and 1195; and as he is known to have reached an advanced age, Gross supposes that he was not born later than 1115. On the other hand, Michael says that as Isaac b. Samuel was spoken of as "the sainted master" a term generally given to martyrs, he may have been killed at the same time as his son Elhanan (1184).</p> <p>May the merit of the tzadik Rabbi Isaac ben Samuel the Elder protect us all.       • text<p style="text-align: right;">רבי יצחק בן שמואל הזקן מדַמְפִּיֶיר (או דַנְפִּיֶיר; בכתיבה הרבנית המקובלת: דנפירא.)  , ובכינויו הנפוץ ר"י הזקן או רבינו יצחק בעל התוספות, היה מראשוני בעלי התוספות במאה ה-12 וממייסדי המפעל אדיר-ההיקף של התוספות</p> <p style="text-align: right;">מראשות ישיבתו בדמפייר ניצח ר"י הזקן, אחיינו של רבנו תם, על כל יצירתם המוקדמת של התוספות. מלבד יצירתו התלמודית-תאורטית, היה ר"י גם גדול הדור, ופסקי ההלכה שכתב שוגרו לכל רחבי אירופה; בנוסף לכך עסק בכתיבת פירושים למקרא.</p> <h3 style="text-align: right;">קורות חייו</h3> <p style="text-align: right;">תאריכי לידתו ופטירתו של ר"י הזקן אינם ידועים בוודאות. שנת לידתו מתוארכת סביב שנת ד'תתע"ה (1115). תאריך פטירתו בלוח העברי הוא כ"ז בתשרי. היו ששיערו ששנת פטירתו היא ב-ד'תתקל"ה (1175), אך הוכח שהיא בין השנים ד'תתקמ"ה (1185) – ד'תתקנ"ט (1199), כשההשערה הקרובה יותר היא לכיוון ד'תתקמ"ח (1188) – ד'תתק"נ (1190).</p> <p style="text-align: right;">דודיו של רבי יצחק היו ראשוני בעלי התוספות, והם האחים רבנו תם, רשב"ם וריב"ם. רבנו תם, הפָּעיל שבין האחים, היה מנהיגה של יהדות צרפת ובעל השפעה גדולה על יהדות אשכנז; נוסף על כך, לאחר עקירתו מעיר מולדתו רמרו אל עירו של סבו רש"י, טרוייש, הקים שם רבנו תם ישיבה גדולה בראשותו, ובה למדו "תלמידים לרוב בלי מספר", כלשונו של רבי שלמה לוריא, וממנה יצאו רוב גדולי הדור לעתיד. ר"י הזקן למד בצעירותו אצל דודו ריב"ם, אולם הריב"ם נפטר בגיל מוקדם, ולאחר מכן למד ר"י בישיבתו של רבינו תם בטרוייש, אליה בא ר"י מעירו רמרו. ר"י היה מקורב מאוד לרבנו תם, והיה שרוי עמו בידידות עמוקה; הם התנצחו זה עם זה בהלכה פעמים רבות, וכאשר צדק ר"י בדבריו הודה לו רבנו תם וקיבל ממנו. בשלב מסוים שב רבי יצחק לרמרו והקים בה ישיבה, עוד בחייו של רבנו תם; לאחר מכן העתיק את ישיבתו לעיר דמפייר.</p> <p style="text-align: right;">רבנו תם נפטר בשנת ד'תתקל"א (1171), ואז היה ר"י הזקן כבר בן למעלה מחמישים; מלבד זאת, מצויות גם תשובות רבות שהשיב בהלכה להמוני שואליו מצרפת ומחוץ לה. בתשובותיו הוא מזכיר את סבתו מרים בתו של רש"י, ואת אלווינא בתו של הריב"ן. ר"י היה מורם של רבים מחכמי אשכנז וצרפת, ומגדולי תלמידיו בצרפת הם רבי יהודה שירליאון, רבי שמשון מקוצי והאחים הש"ר משאנץ והריצב"א, ובאשכנז רבי יהודה בן קלונימוס משפיירא, ורבי אברהם בן עזריאל תלמיד רבי ברוך מרגנשבורג ומחבר הספר "ערוגת הבשם".</p> <p style="text-align: right;">ישיבתו הייתה אבן שואבת לתלמידי חכמים, ושמו של רבי יצחק נישא והתפרסם בכל אירופה, כשתלמידיו ומבקשי תורתו פרושים מצרפת ועד אשכנז ובוהמיה, ומאנגליה ועד איטליה. שאלות רבות שוגרו אליו בכל תחומי ההלכה, ביניהן מגדולי דורו כמו רבינו חיים הכהן מפריז, רבי יוסף מאורליינש (בכור שור), והקדוש רבי יום טוב מיואני - תלמידי רבנו תם, רבי אשר מלוניל תלמיד הרז"ה, רבי ברוך מרגנשבורג תלמיד הריב"ם, רבינו יואל הלוי אבי הראבי"ה, רבי משה מלונדריש (לונדון), רבי שמואל מאניוב (אולי היא אנז'ו), חכמי לוניל, ורבים אחרים.</p> <p style="text-align: right;">רבי מנחם בן זרח כותב בהקדמתו לספרו "צידה לדרך":</p> <p style="text-align: right;">"רבינו יצחק בן אחותו של רבנו תם, הנודע [בשם] 'בעל התוספות', אשר למד ולימד בישיבה; כי העידו לי רבותי הצרפתים בשם רבותם, כי נודע ונתפרסם שהיו לומדים לפניו שישים רבנים, שכל אחד מהם היה שומע ההלכה שהיה מגיד, גם היה לומד כל אחד לבדו מסכתא שלא היה לומד חבירו, והיו חוזרין על פה; ולא היה מגיד רבינו יצחק הלכה שלא היה בפיהם בין כולם כל הגמרא [=כל הש"ס] בין עיניהם באותה הגדה, עד שנתבררו להם כל ספיקות שבגמרא. וכל הלכה ומאמר תנא או אמורא שנראה היפך או סתירה במקום אחר, יישב ותיקן על אופנו, כאשר מבואר לכל מי שראה תוספותם ושאלותם ותשובתם ופירושם וההשגות שהשיגו [רבנו תם ור"י] על זקנם רבינו שלמה."</p> <p style="text-align: right;">ואכן תלמידיו מזכירים את הערותיו על תוספותיהם שישבו ופירשו לפניו.</p> <p style="text-align: right;">ר"י נשא לו לאשה את בתו של רבי יהודה מפריז, נכדם של הריב"ן ומרים בת רש"י. ממנה נולד לו בנו אלחנן, לימים אחד מתלמידיו הגדולים; בין הבן לאביו שררו יחסים חמים, ורבי יצחק היה מפלפל עמו בהלכה, דורש בעצתו ואף מעיין בחיבוריו של רבי אלחנן, שהפך גם הוא לאחד מגדולי בעלי התוספות. בשנת ד'תתקמ"ד (1184), עוד בחייו של רבי יצחק, נרצח בנו רבי אלחנן על קידוש השם, מאורע שהיה קשה מאוד לאב השכול. רבי אלחנן הותיר אחריו בן יחיד, שמואל, שנולד בשנה בה נרצח אביו; התינוק הובא לבית סבו רבי יצחק, ור"י גידל בביתו את היתום כל ימיו.</p> <p style="text-align: right;">לאחר מות ר"י הזקן הפכו האחים רבינו שמשון משאנץ והריצב"א ליורשיו התורניים, כאשר הריצב"א מילא את מקומו בראשות בית המדרש של דנפירא ואילו אחיו חזר אל שאנץ, עיר הולדתם, והפך שם למקור הוראה ופלפול עיקרי – הש"ר משאנץ הוא שנחשב בדרך כלל ליורשו הרוחני ולתלמידו המובהק של ר"י הזקן. גם תלמידיו האחרים נעשו אז למורי הוראה ורבנים מגדולי הדור, כאשר הוקמה בפריז ישיבתו של רבי יהודה שירליאון, ובטרוייש ישיבתו של רבינו שלמה הקדוש מדרוייש.</p> <h3 style="text-align: right;">קווים לדמותו</h3> <p style="text-align: right;">רבי יצחק היה נערץ על כל סביביו. בדמותו הציבורית היה ר"י סמכות תורנית שהנהיגה ברמה את כל יהודי אירופה; מכל קצוות היבשת הריצו אליו השואלים את ספיקותיהם, ותלמידים נהרו לפתחו מכל הארצות. מעמדו השתווה רק לסמכותו של דודו רבנו תם לפניו. תלמידיו רחשו לו הערכה אדירה, והם ותלמידיהם מכנים אותו רבות בשם "רבינו הקדוש".</p> <p style="text-align: right;">גם בדמותו האישית היה רבי יצחק אדם משכמו ומעלה. רבי יצחק היה ענוותן גדול מטבעו, ולכל שואליו השיב בכניעות ובשפל רוח, ואף בפסקיו מעולם לא עמד על דעתו בתוקף כנגד דברי אחרים. כמעט בכל עת שראה כי רש"י או רבנו תם, רבותיו, סברו להלכה שלא כמותו, ביטל את דעתו מיד מפני דבריהם. מחמת הליכותיו הצנועות והרכות הפך לפוסק המוסכם על הכל, ופסקיו נתקבלו על רבים מהפוסקים שבאו בעקבותיו.</p> <p style="text-align: right;">למרות העליונות המוחלטת שנתנו בני דורו לפסקיו, ר"י עצמו ברח תמיד מן ההוראה ולא היה סומך על פסקיו שלו כלל. באחת מתשובותיו כותב ר"י, "אבל לא מלאני לבי מעולם להתיר אפילו לאחרים, וכל שכן לעצמי, לפי שאין בידי קבלה בדבר, ... וטוב בעיני שישאלו לאחרים ואל יסמכו על סברתי."</p> <p style="text-align: right;">ר"י הזקן סיגף את עצמו בתעניות רבות, ובתוספות מובא כי היה צם בכל יום ראשון בשבוע.</p> <p style="text-align: right;">ר"י נהג על עצמו חומרות רבות, ואף בדברים בהם היה פוסק להלכה להקל, חשש להקל לעצמו; לדוגמה, נהג להתענות שני ימים ביום הכיפורים, מספק. בתוספות הביאו שלדעת רבנו תם, דין הגמרא לפיו יש לאדם להמתין בבית הכנסת עד שיסיים חברו את תפילתו, נאמר רק בזמן התלמוד אז היו בתי הכנסת מרוחקים מהעיר, וסכנה הייתה להימצא בהם ביחידות, אך לא בזמננו אנו; אך אף שר"י קיבל את סברתו של רבנו תם להלכה, מסופר שם כי הוא עצמו היה מתפלל ארוכות ומאחֵר בתפילתו ומאריך בה עד שיצאו כולם, ואם כששהה שם היה אי-מי נכנס לבית הכנסת ומתחיל אז להתפלל, היה רבי יצחק מחכה שיצא ומעיין בספר עד שיגמרו כל הנוכחים את תפלתם.</p> <p style="text-align: right;">נכדו, רבי שמואל בן הקדוש רבי אלחנן, מביא פעמים מספר הנהגות שראה אצל סבו.</p> <h3 style="text-align: right;">מורשתו </h3> <p style="text-align: right;">ר"י הזקן הוא המחבר הראשון של התוספות, ובחיבורי הראשונים הוא מכונה גם "בעל התוספות" סתם. במפעלו זה יצר שיטת לימוד חדשה בתכלית בעולם התורני, שענפיה מגיעים עד לימינו אנו. רבי מנחם בן זרח בעל ה"צידה לדרך" טוען בהקדמתו לספרו כי כל לימוד התלמוד הבבלי בימינו נובע מפעילותם של רש"י ובעלי התוספות.</p> <p style="text-align: right;">כל מאות בעלי התוספות שבאו אחריו הניחו להם ליסוד את דברי ר"י ורבנו תם, הן ביישוב סוגיות סותרות והן בפסקי הלכות, ואף אם חלקו עליהם או פירשו בדרך שונה תמיד היו להם דבריו ליסוד. כפי שכותב תלמידו הסמ"ג בהקדמתו לספרו, ר"י נמנה - יחד עם רש"י ורבנו תם - כאחד מגדולי החכמים אשר כל חכמי ישראל האחרונים שותים את דבריהם.</p> <p style="text-align: right;">רבינו ישעיה הזקן מטראני כתב בתשובותיו: "תחילת כל דבר אני משיב לאדוני על מה שכתבת אלי שלא אחלוק על הרב הגדול רבינו יצחק זצ"ל, חלילה לי מעשות זאת ולא עלתה במחשבה כחולק עליו, ומה אני נחשב - פרעוש אחד, כתרגומו, כנגד תלמידו; אף כי בדבֵּר אחרי המלך!"</p> <p style="text-align: right;">המהרש"ל כתב בספרו 'ים של שלמה': "מצאתי בתשובות הרא"ש שכתב, שהאיש רבי משה בר מימון גדול היה מאוד בכל החכמות, מכל מקום כשהוא חולק עם רבנו תם ור"י - שלא לשמוע אליו, אלא לילך אחרי בעלי התוספות. כי קבלה בידו, שרבינו תם ור"י הצרפתים היו גדולים בחכמה ובמניין יותר מן הרמב"ם."</p> <h3 style="text-align: right;">חיבוריו</h3> <p style="text-align: right;">ר"י חיבר תשובות ופסקים רבים, שרובם אינם נמצאים בידינו; כמה מהם נדפסו על ידי הרב משה יהודה בלוי בספר "שיטת הקדמונים" על מסכת עבודה זרה, בניו יורק ה'תשנ"א. רוב התשובות שבקובץ הועתקו בידי תלמידיו של ר"י, רבינו אלחנן בנו והר"ש משאנץ. פסקים אחרים שלו נדפסו על ידי שמחה אסף בספר היובל לכבוד אלכסנדר מרכס, ניו יורק ה'תש"י. תשובות רבות שלו מצויות גם בספרי ההלכה של הראשונים כמו המרדכי, האור זרוע, הגהות מיימוניות ועוד.</p> <p style="text-align: right;">נוסף לתוספותיו ותשובותיו המרובות, לא הזניח ר"י את לימוד התנ"ך, וכתב אף פירוש על התורה, שנקרא ככל הנראה "ליקוטי מדרש"; פירושיו מובאים כמה פעמים בחזקוני ובפירושי ראשונים נוספים שעל התורה. מלבד זאת, ככל הנראה כתב ר"י גם מספר פיוטים. נוסף לכך חיבר אף פירוש להלכות הרי"ף, אשר הרא"ש מצטט ממנו פעמים מספר. על פי השמועה היה לר"י יד אף בתורת הנסתר.</p> <p style="text-align: right;">מוזכר גם כי ר"י חיבר קונטרס על תיקון הגט.</p> <p style="text-align: right;">בש"ס וילנא הודפס בצד גיליון הגמרא במסכת קידושין פירוש בשם "תוספות ר"י הזקן", אך הזיהוי הופרך כבר בש"ס ווילנא עצמו (בדבריהם שבשער כל מסכת) על פי המובאות של ספרים מאוחרים כמו פירושי הרמב"ם או ספר התרומה (תלמידו של ר"י) בפירוש זה. לבסוף הוכח על פי סגנונו כי הכותב הוא רבי אברהם מן ההר, בן המאה ה-14.</p> <p style="text-align: right;">בשנת 2001 נתגלה כתב יד המכיל פירושים מדברי בעלי התוספות ובעיקר מר"י הזקן. עיקרו של הקובץ הוא על מסכת שבת (החל בדף י"ג), וההשערה הנבדקת היא שהכותב היה מתלמידיו של ר"י הזקן, משום שעל חלק מהדברים נחתם מ"ר = מפי רבי, חתימה האופיינית לתלמידי ר"י. כמה מהדברים שבקובץ מצויים בתוספות המצויים שנדפסו בש"ס וילנא למסכת שבת. כמו כן, מכיל הקובץ תוספות שחוברו על ידי תלמידי רבינו תם, ריב"א, רשב"ם, ראב"ן, רבי אליעזר ממיץ, ר"י פורת, ואחרים. כתב היד פורסם בצירוף מבוא והערות על ידי הרב אברהם שושנה בשנת 2007.</p> <h3 style="text-align: right;">משפחתו</h3> <p style="text-align: right;">סבו של ר"י הזקן היה רבינו שמחה מוויטרי, תלמידו של רש"י ועורך מחזור ויטרי; בנו של רבינו שמחה היה רבינו שמואל החסיד מוויטרי, אביו של ר"י, שנישא למרים – בתם של יוכבד, בתו של רש"י, ורבינו מאיר חתן רש"י, "אבי הגאונים". מרים הייתה אחותם של גדולי הדור, נכדי רש"י: רבי יעקב (רבנו תם), רבי שמואל (רשב"ם), רבי יצחק (ריב"ם) ורבי שלמה ("אבי הדייקנים").</p> <p style="text-align: right;">ר"י נישא לבִתו של רבי יהודה מפריז בן רבי יום טוב, מבעלי התוספות;       • text<p>No confundir con Isaac ben Samuel de Acre.</p> <p>El rabino Isaac ben Samuel el Viejo (c. 1115 - c. 1188/1190), también conocido como Ri ha-Zaken (en hebreo: <span dir="RTL">ר</span>"<span dir="RTL">י</span> <span dir="RTL">הזקן</span>), fue un tosafista francés y comentarista bíblico. Floreció en Ramerupt y Dampierre, Francia en el siglo XII.</p> <p>Biografía</p> <p>Por parte de su padre, Isaac era nieto de R. Simhah ben Samuel de Vitry, autor del Maḥzor Vitry; por parte de su madre, era sobrino de Rabbeinu Tam, de Rashbam y de Isaac ben Meir (RiBaM), bisnieto de Rashi y pariente de R. Eleazar de Worms. Fue apodado "ha-Zaḳen" (el mayor) para distinguirlo de otro tosafista del mismo nombre, Isaac ben Abraham apodado "ha-Baḥur" (el menor). A menudo se le cita como R. Isaac de Dampierre.
