 textר' אליהו יוסף ראבינאוויטש נולד בשנת תר"י לאביו ר' גדליהו אהרן בעל "חן אהרן" מליניץ וסקאליווקא בן ר' יצחק יואל מליניץ בן הרה"ק ר' גדליהו בעל "תשואות חן" מליניץ זי"ע מתלמידי מרן אור שבעת הימים הבעש"ט זי"ע. ולאמו הרבנית בילא בת ר' שמואל אברהם אבא שפירא מסלאוויטא בן ר' משה מסלאוויטא בן הרה"ק ר' פנחס מקאריץ זי"ע. כשהגיע לפרקו נשא את בת ר' משולם זושא יצחק מטלומאטש (נכד באח"ב להרה"ק הרבי ר' זושא מאניפאלי זי"ע) חתן ר' יעקב ישראל מטשערקאס בן הרה"ק ר' מרדכי מטשערנאבל זי"ע. מעולם מאס בכתר האדמורו"ת ומשרת הרבנות וישב עה"ת ועל העבודה, והתקשר בקשר אמיץ וחזק לגיסו (בן חותנו) הרה"ק ר' מרדכי דוב מהארנאסטייפל זי"ע. בזיוו"ש נשא את בת הרה"ק ר' יעקב יצחק ממאקארוב זי"ע נכד הרה"ק מטשערנאבל זצ"ל והתיישב בקעשינוב, ובעת מאורעות הפאגראמים בקעשינוב היגר לארה"ב בשנת תרס"ז ונתיישב ב'איסט סייד' במאנהעטן. בשנת תר"ע עבר לעיר באפאלאו במדינת ניו יארק לשמש ברבנות קהל "ברית שלום - אנשי רוסיא" ושם נסתלק ביום י"ג חשון תרע"א ושם הובל למנוחות ובנו אהל על קברו. בפנים האהל לא שמו מציבה כפי מנהג טשערנאבל ועוד צדיקים, ובשלט על פי פתח האהל חרתו אלו הדברים : פ"נ בן פורת יוסף, גאון חריף וחכם לב סיני ועוקר הרים, מורנו הרב ר' אליהו יוסף בהה"צ הר' גדליה אהרן זצ"ל מחצבתם קודש, שלשלת היחוס מקדושי סלאוויטא וליניץ זי"ע נפ' י"ג מרחשון תרע"א לפ"ק ת' נ' צ' ב' ה' <a href="http://3.bp.blogspot.com/-KX_Aynwf-YI/VL6jEROjlVI/AAAAAAAACTM/spTyznkktX0/s1600/20081112_6231312120_%D7%99%D7%92%2B%D7%97%D7%A9%D7%95%D7%9F%2B%D7%97.jpg"><img src="http://3.bp.blogspot.com/-KX_Aynwf-YI/VL6jEROjlVI/AAAAAAAACTM/spTyznkktX0/s1600/20081112_6231312120_%D7%99%D7%92%2B%D7%97%D7%A9%D7%95%D7%9F%2B%D7%97.jpg" /></a> האהל בעיר באפאלאו נ.י. על קברו של הרה"צ רבי אליהו יוסף זצ"ל נצר לשושלת ליניץ מגזע הגה"ק בעל תשואות חן מתלמידי הבעשטה"ק זי"ע בעיית העגונות באמריקה בימי מלחמת העולם הראשונה בה נלקחו אלפי יהודים לצבא מבלי באי ביתה, והרבה מנשותיהם נשארו עגונות בלי ידיעה ברורה על גורל בעליהם, אם שרדו בחיים או נהרגו רח"ל בשדה הקרב, שקדו גדולי ישראל בכל מקומות מושבותיהם להציל את בנות ישראל מכבלי העיגון, ועל כל עגונה ועגונה ישבו בתי דינים בכל ערי ישראל לעיין בדיניהם ולנסות להתירם להינשא כדת וכדין עפ"י ההלכה, ואזרו חיל בכחא דהתירא לתקנות העגונות האומללות. באמעריקא שבימים ההם היתה בעיית העגונות מסוג נוסף על אלו שבאירופה, מלבד מה שהרבה עגונות עזבו את ארצות מולדתיהם והיגרו לאמעריקא, ועקבות בעליהם בצבא לא נודע ונשארו גלמודות, שררה פה רוח של הפקרות פריקת עול, והיה אלו שהיגרו לאמעריקא עם בעליהם אבל הבעלים עזבו אותם ונמלטו לעיירות אחרות לחיות חיי הפקר, מבלי לגרש את נשותיהם שאותם עזבו לאנחות עניות ומרודות ועיניהם כלות ומיחלות לתיקון. בהעיתונים של אז חוללה רעש על ענין "תקנת עגונות" רעש שהתחילה בקצה המחנה ע"י העיתונים החילונים עם טענות על הרבנים שישבו על מדין ומה אינם עונים לקול שועת אסורו"ת של אחותיהם בנות ישראל, ואינם עושים מה שיבכלתם להתירם מכבלי עיגונם. בכל יום יום קמו כתבנים ולברלרים עם עצות להרבנים מה יעשו ואיך יעשו, וכל הגולה היתה כמדורת אש, ובפרט אחרי שהסמינר של הרע-בנים בראשות דר. שניאור זלמן (סאלאמאן) שעכטר הידוע לשמצה רצו לחדש הענין של "תנאי בנישואין" וגדולי ישראל מכל קצוי תבל הרעישו עולמות נגד דבר כזה. הצעת תקנת עגונות ע"י האדמו"ר רבי יוסף ראבינאוויטש מבאפלאו בחודש תמוז שנת תרע"א כמו חצי שנה לאחרי פטירת האדמו"ר רבי אליהו יוסף ראבינאוויטש בעיר באפאלאו אשר בניו יארק, נדפס בהעיתון "די ווארהייט" מכתב של ראשי קהילות "ברית שלום" ו"דורש לציון" שבבאפאלו, וחתומים בשמותם; אלימלך אלאק, משה סמולאוו, יצחק קעץ וחיים קאהן ובה מפרסמים דעת תורתו של רבם לשעבר הגאון רבי יוסף ראבינאוויטש שמצאו בין כתביו ברצון לפרסמו רק שנטרפה עליו השעה, ועפ"י עדותם מסרו האדמו"ר גם בעל-פה בביקורו פעם במשרדת המערכת של העיתון, לעורר לבב הרבנים עם הצעה לתקנות עגונות. החידוש שבמכתב הזה הוא שהתקנה, על אף שאינו רק בתורת הצעה, ובלשונו בחתימת מכתבו "סוף דבר, לבי לבי לחוקקי ישראל, מי לד' אלי, מקום הניחו לי להתגדר בו, ואתם גם אתם שחרו מכחכם לתקנות עגונות, אני פתחתי לכם פתח כפתחו של מחט, ואתם פתחו לי פתח כפתחו של אולם, ויחשב לכם לצדקה כי פי ה' דובר, וחי בהם" אבל כשנעיין על פתחו שפתח כפתחו של מחט נראה שזה מעין מה שפתחו הפוקרים בהצעה להנהיג תנאי בקידושין שעל ידה יופקעו הקידושין למפרע באם הבעל יעזוב את אשתו, ולא נהיה נצרכים לחכות על גט פיטורין. בתוך הדברים מוסיף רבי יוסף שבזכרונו כאשר פעם עסק בענין תקנה לעגונה בעת היותו עדיין בארץ מגורי אבותיו, וגם אז רצה לחדש ענין של תנאי ולקח הסכמה על ההיתר מ"ידידי הרב הגאון הרי"א מקאוונע, ומגיסי הרב הגאון והצדיק רבי מרדכי דוב מאירנאסאפליע" והסכימו שניהם על הסברא, והרבי ר' מאטעלע אף כתב לו בכתב עם תוספות מראי מקום שגם התרומת הדשן בפסקים סי' קל"ט ס"ל כן. מן הנכון לציין שבענין כעין זה יש תשובה שנדפסה בספר "ענף עץ אבות" להג"ר דובער מענקיס שנדפסה בזיטאמיר בשנת תר"ס בהסכמת גודלי וצדיקי דורו, ושם בסי' א' כותב באריכות בענין היתר עגונה ומקדים שקיבל ע"ז הסכמה מהרמ"ד מהארנאסטייפל זצ"ל (ועי' שם בהסכמת הרה"צ רבי ישעי' ממקארוב שכותב בפירוש שאינו מסכים על היתר העגונה שבתשובה א').
